Prayer in the instant petition is for grant of anticipatory bail to the petitioner in case FIR No.72 dated 07.07.2024 under Sections 115(2), 127(4), 140(3), 351(3), 318 (4), 61(2) of the Bhartiya Nyaya Sanhita, 2023, registered at Police Station Badhni Kalan, District Moga. 2.
On the 04.10.2024, while noticing the following submissions made by the learned counsel for the petitioner, this Court had granted the concession of interim bail to the petitioner and asked him to join investigation:- "Learned State counsel, on instructions from ASI Jarnail Singh, has not disputed the submissions made by learned counsel for the petitioner that it was not the petitioner who was running illegal de-addiction centre but it was being run by co-accused, namely, Garry Arora. On a further query, it has also not been disputed by learned State counsel that the petitioner has no previous criminal antecedents; rather it has been submitted that the petitioner was just an employee of co-accused-Garry Arora."

Learned counsel for the petitioner submits that in compliance of order dated 04.10.2024, the petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 04.10.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
