Counsel appearing for the respondent informs the Court that before the Executing Court, execution proceedings had already been decided before the institution of present appeal before this Court, vide order dated 15.12.2012, after satisfying the decree.

A perusal of the case files shows that on 09.09.2019, 17.01.2020, 07.07.2022, and 10.05.2023, continuously, there was no representation on behalf of the appellant. In the order dated 10.05.2023, it has been specifically mentioned that notice to counsel for the appellant be issued to appear and address arguments on the next date of hearing, i.e. fixed as 05.07.2023 i.e. today. 3.

As per office report also, counsel for the appellant has been informed through e-mail also, about the date fixed before this Court. Despite all this, there is no representation on behalf of the appellant in Court today. It appears that appellant is not interested in pursing the present appeal any more, as the same is pending since the year 2013.

Dismissed for non-prosecution.
