GURBIR SINGH , J.(Oral) Learned counsel for the petitioner, at the outset, submits that appeal was filed on 21.04.2023 and notice in the appeal as well as in the application for stay were issued to the contesting respondents No.1 to 4. They have already appeared and the other proforma respondents have not appeared in the trial Court as per the order dated 12.04.2023. He further submits that he would be satisfied if application for stay is decided at the earliest.

In view of the statements made by learned counsel for the petitioner, this petition stands disposed of with the direction to the learned Appellate Court if any request is made by learned counsel for the applicant/petitioner for dispensing with the service of proforma respondents and their presence can be dispensed with then their service be dispensed with and application for stay moved by the applicant/petitioner be disposed of expeditiously not later than period of one month. Learned counsel for the petitioner is directed to appear in the learned Appellate Court on 24.08.2023.
