The present petition has been filed under Section 482 of the BNSS/438 Cr.P.C. seeking grant of anticipatory bail to the petitioner in case FIR No.101 dated 16.05.2026 for offences punishable under Section 21(B), 29 of the Narcotic Drugs and Psychotropic Substance Act, 1985, registered at Police Station Sadar Bathinda, Punjab.

The case of the prosecution is that on 16.05.2026, co-accused Gurdeep Singh was apprehended and alleged recovery of 115 grams of heroin was effected from him. The petitioner was implicated on the basis of the disclosure statement made by the co-accused. 3.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further argued that the disclosure statement made in the custody is not an admissible evidence and apart form disclosure statement there is no other evidence against the petitioner. Learned counsel further submits that, however, the petitioner is ready and willing to join the investigation.

Mr. Parneet Singh Pandher, A.A.G., Punjab accepts notice on behalf of the State and has opposed the prayer for grant of bail to the petitioner on the ground of gravity of allegations. He further submits that the petitioner is involved in 02 more cases under the NDPS Act. 6.
I have heard the learned counsel for the parties and perused the record.

The allegations pertain to an offence under the NDPS Act, which is a special statute enacted to curb the menace of narcotic drugs and psychotropic substances. Keeping in view the entire facts and circumstances of the case, nature and gravity of the allegations, the stage of investigation, and the criminal antecedents attributed to the petitioner, the custodial interrogation of the petitioner is necessary for thorough and effective investigation of the case. Therefore, considering the seriousness and gravity of the allegations, no exceptional or extraordinary grounds are made out for grant of anticipatory bail to the petitioner. 8.
Accordingly, the present petition is dismissed. 9.
Pending miscellaneous application(s), if any, shall also stand disposed of.
