The petitioner has approached this Court seeking grant of 4 weeks parole on grounds of illness of his wife.

Reply has been filed by learned State counsel by way of affidavit of Sh. Joginder Pal, Superintendent, Central Jail, Faridkot, which is accompanied by order dated 16.6.2020 (Annexure R-2/T), vide which the case of the petitioner for grant of special parole has been declined. A perusal of the said order, however, shows that there is no such reference to the illness of petitioner's wife.

In the present case, the petitioner has annexed his application dated 28.10.2019 (Annexure P-3) (though the learned counsel for the petitioner claims that the date has been inadvertently incorrectly mentioned and the PANKAJ KAKKAR 2022.05.10 16:51 I attest to the accuracy and authenticity of this document

( 2 ) CRWP-10499-2021 (O&M) correct date is 28.10.2021) seeking grant of 4 weeks parole, wherein a specific ground has been taken that his wife has serious ailment and has been advised surgery.

Since it appears that the authorities concerned have not considered the said application particularly as regards the ground taken by the petitioner i.e. illness of his wife, the authorities concerned are directed to consider and dispose of the application (Annexure P-3) within a period of 4 weeks from today. It shall be open to the petitioner to furnish requisite supporting documents to substantiate his case as regards illness of his wife. 5.

A copy of this order alongwith copy of application (Annexure P-3) be conveyed to respondent No.2-Deputy Commissioner, Faridkot and respondent No.3-Superintendent, Central Jail, Faridkot for necessary compliance.
