AT CHANDIGARH Date of Decision: 25.06.2026 Archana and another .....Petitioners

VERSUS

State of Punjab and others .....Respondents CORAM: HON'BLE MR. JUSTICE HARPREET SINGH BRAR Present :

Mr. Randeep Singh Gill, Advocate for the petitioner. Mr. Bhanu Pratap Singh, Addl. AG, Punjab.

HARPREET SINGH BRAR, J. (ORAL) 1.

The present petition has been filed under Article 226/227 of the Constitution of India for issuance of an appropriate order or direction in the nature of mandamus directing respondent No.2 to protect the live and personal liberty of petitioners by providing security/police protection to petitioners and also directing respondent No.4 not to interfere in personal live and liberty of petitioners and further directing respondent No.2 not to allow respondent No.4 or anybody else to interfere with liberty and live of petitioners or to harass them in any manner.

2.

Learned counsel for the petitioners, inter alia, contends that petitioner No. 1 is the legally wedded wife of respondent No. 4 and petitioner No. 2 is their son. Out of the wedlock, three children were born. The petitioners have been subjected to physical and mental cruelty by respondent No. 4, a habitual drunkard, who frequently assaults and threatens them. It is contended that on 19.05.2026, respondent No. 4, under the influence of alcohol, abused petitioner No. 1, threatened her and her relatives, and assaulted her with an iron rod in the presence of the children. When petitioner No. 2 intervened to rescue his mother, he was also assaulted and suffered grievous injuries, including a fractured nasal bone. Further, despite submitting a representation dated 21.05.2026 (Annexure P-1) seeking protection and action against respondent No. 4, no effective steps have been taken by the police authorities. Due to the continued threats and violence, the petitioners are living in constant fear for their life and personal liberty.

3.

It is further submitted that the petitioner made a representation dated 21.05.2026 before the jurisdictional police authorities; however, no action has been taken thereon and the same is still pending. Learned counsel submits that he would be satisfied if the petitioner's representation (Annexure P-1) is considered and decided by the competent respondent by passing a speaking order within a time bound manner. 4.

Notice of motion restricted to official respondents only.

5.

Mr. Banu Pratap Singh, learned Additional Advocate General, Punjab, accepts notice on behalf of the official respondents and submits that he has no objection, in case a direction is issued to the respondent No.2/competent authority for time bound consideration and decision of the representation dated 21.05.2026 (Annexure P-1). 6.

Therefore, in view of the limited prayer made by learned counsel for the petitioners, respondent No.2 is directed to consider the representation dated 21.05.2026 (Annexure P-1) of the petitioners and pass a speaking order, after affording an opportunity of hearing to the petitioners, within a period of two weeks from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioners. Needless to say, if the petitioners are found entitled to the relief sought, the same shall be granted forthwith by respondent No.2. 7.

Disposed of, accordingly.

8.

Pending miscellaneous application(s), if any, shall also stands disposed of.
