***** Rajan Gupta, J. (Oral) Petitioner was working as a Work Inspector in the respondent No.2-department. His stand is that he suffered from certain illness due to which was was referred to PGIMER, Chandigarh. As he found it very difficult to travel or sit continuously, he submitted an application seeking earned leave alternatively to grant him premature retirement. On 03.11.2016, he again submitted a representation in the same terms. On 30.11.2016, however, he wrote a letter, Annexure P-9, seeking voluntary retirement. Only plea raised by the petitioner is that he ought to have been retired w.e.f. 30.04.2017 in view of his application, Annexure P-9. Stand of the State, however, is that after counting three months' period as notice period, the date of voluntary retirement was correctly fixed by the department.
