Tribhuvan Dahiya, J. (Oral) The petition has been filed, inter alia, seeking direction to respondents No.2 and 3 to carry out a fair and transparent investigation in case FIR No.144 dated 17.07.2024, under Sections 341, 323, 324, 336 and 34 IPC and Section 30 of Arms Act registered at Police Station Dasuya, District Hoshiarpur, Annexure P-1.

At the outset, learned counsel for the petitioner contends that the petitioner will be satisfied in case second respondent is directed to decide the petitioner's representation dated 19.07.2024, Annexure P-3 seeking conduct of an inquiry into the matter by an impartial officer. 3.

Learned State counsel, however, referred to the short reply by way of an affidavit filed on behalf of respondents No.1 to 4 to contend that the petitioner had submitted an application No.2693 dated 22.07.2024 to the SONIA BURA 2025.02.14 17:06 I attest to the accuracy and integrity of this document

CRM-M-39099-2024 -2second respondent for inquiry into the matter, and the fifth respondent Palwinder Singh also submitted an application No.157 INV dated 30.07.2024 to him for the same purpose. Both the applications were marked for inquiry to the predecessor of the deponent/Jatinder Pal Singh (PPS), Deputy Superintendent of Police, Sub Division Dasuya, District Hoshiarpur. Learned State counsel, however, is not in a position to refer to any decision taken by the second respondent on the petitioner's application seeking conduct of impartial inquiry.

In view thereof, the petition is disposed of with a direction to the second respondent to decide the petitioner's representation dated 19.07.2024, Annexure P-3, in case no decision has been taken on it so far, within four weeks and to convey it to him as well.
