Petitioner has preferred this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case bearing FIR No.41 dated 03.03.2020 under Sections 307, 148, 149, 506 IPC and under Section 25/27 of Arms Act (Section 336 IPC added later on) registered at Police Station Division-C, District Amritsar City.

As per allegations in the FIR, petitioner is author of gun shot injury which hit Rohit in his stomach. FIR was JYOTI YADAV 2021.08.17 13:23 I attest to the accuracy and integrity of this document

CRM-M No. 42320 of 2020 -2registered for the offences under Sections 307, 148, 149, 506 IPC and under Section 25/27 of Arms Act at Police Station Division-C, District Amritsar City.

Learned counsel for the petitioner submits that the parties have entered into a compromise on 29.09.2020 and his prayer for anticipatory bail be considered.

In view of judgment of Hon'ble Apex Court in State of Madhya Pradesh vs Laxmi Narayan and others, AIR 2019 SC 1296, offence under Section 307 IPC cannot be compounded at this stage.

In view of aforesaid position, no indulgence can be granted in favour of the petitioner.

Dismissed.
