M.M.S. BEDI, J. (ORAL) The petitioner is aggrieved by the action of respondent Nos.2 and 3 by not considering his request for grant of access to the approach road from India Gate, Attari Border, Amritsar. Without expression of any opinion whether the petitioner has got a legally enforceable right as per the situation existing, on the spot, I deem it appropriate to dispose of this petition, at this stage, as pre-mature because the petitioner has already submitted a representation Annexure P2, to the Superintending Engineer PWD (B&R), Amritsar, and the Deputy Commission-cum-Collector, Amritsar.

Counsel for the petitioner submits that the petitioner would be satisfied in a case a direction is issued to the Superintending Engineer PWD (B&R), Amritsar, to consider the representation Annexure P2, by passing a speaking order taking into consideration the situation Raj Kumar Arora 2017.03.24 16:57 I attest to the accuracy and integrity of this document

On asking of the Court, notice has been accepted by Ms.Anu Pal, Asstt. A.G. Punjab, present in the Court. Counsel for the petitioner will supply to sets of paper book to the State counsel during the course of the day. This petition is disposed of with a direction that the Superintending Engineer PWD (B&R), Amritsar Circle, Amritsar, respondent No.2, shall decide the claim of the petitioner within a period of three months after the receipt of a certified copy of this order and in case no such representation has been received, Annexure P2, will be considered as representation to be decided by assessing the situation existing on the spot.
