(Oral) Challenge in the present revision petition is to the order dated 18.07.2023 (Annexure P-3) passed by learned Motor Accident Claims Tribunal. The impugned order was passed on the application filed at the instance of the petitioners (who were respondents No.1 and 2 before learned Tribunal), thereby making a prayer for appointment of the Local Commissioner to visit the spot of accident to report as to whether the accident can take place, in the manner, as so projected by the respondents/claimants. However, at this stage, learned counsel for the petitioners submits that he does not want to pursue with the present revision petition and seeks permission to withdraw the same with the liberty to avail appropriate remedy, by way of examination of witness, to so substantiate the plea, as so raised in this petition for appointment of Local Commissioner.
