* * * ANIL KSHETARPAL, J. (ORAL) Petitioner prays for grant of regular bail in FIR No.23, dated 31.1.2019, registered under Sections 147, 148, 323, 324, 326 and 506/34 IPC, at Police Station Uchana, District Jind. Petitioner is in custody since 17.6.2019.

Learned counsel for the State, on instructions from SI Rajbir Singh, the Investigating Officer, has admitted that police did not seek police remand of the petitioner. However, on 5.9.2019, prayer for bail to the petitioner was opposed by the learned State counsel on the ground that the RAJ KUMAR ARORA 2019.09.17 16:43 I attest to the accuracy and integrity of this document

CRM-M-36377-2019 remaining accused have not been arrested. The Superintendent of Police, Jind, was directed to file affidavit explaining the reasons as to why the other accused have not been arrested if the prosecution requires them. Today, affidavit of Ashwin Shenvi, Senior Superintendent of Police, Jind, dated 14.9.2019, has been filed in the Court, which is taken on record.

Learned counsel for the State submits that the remaining accused have also been arrested after the order dated 5.9.2019. Without commenting on the merits of the case and keeping in view the aforesaid fact that the petitioner is in custody since 17.6.2019, and the trial of the case is likely to take a long time, the petitioner is directed to be released on regular bail subject to furnishing of adequate surety to the satisfaction of the trial Court/Duty Magistrate. Accordingly, the present petition is allowed with the aforesaid directions.
