(ORAL) In the present writ petition, the grievance which is being raised by the petitioner is that though he has already retired from service on 31.03.2013, but all the pensionary benefits, for which he was entitled for upon his retirement, have not been released. Counsel for the petitioner argues that there was one chargesheet, which was issued to the petitioner on 01.03.2012 and a minor punishment of censure was imposed upon him on 19.06.2014. Thereafter, another charge-sheet was served upon the petitioner on 29.01.2014, which was also dropped by the respondents on 16.01.

2017 and thereafter, there was no valid justification with the respondents to withhold the benefits. Counsel further argues that even the benefits, which have been paid to the petitioner, have not been computed correctly. Counsel for the petitioner states that for the relief, which has been sought in the present writ petition, petitioner has served the NARESH KUMAR 2019.08.

CWP-3593-2018 -2respondents with a legal notice dated 21.10.2017 (Annexure P-6), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice by passing an appropriate speaking order.

Notice of motion was issued on 13.07.2018, but none has put in appearance on behalf of the respondents despite service. On asking of the Court, Mr. Sehaj Bir Singh, Advocate, who is present in the Court, accepts notice on behalf of the respondents. A copy of the paper book has been supplied to him. Learned counsel for the respondents states that the respondent-department has no objection in deciding the claim of the petitioner as being made by him in a legal notice in a time bound manner. Keeping in view the request made by counsel for the petitioner and without expressing any opinion on the merits of the case and entitlement of the petitioner in respect of the claim made in the writ petition/legal notice, the respondents are directed to decide the legal notice dated 21.10.

2017 (Annexure P-6) filed by the petitioner within a period of three months from the date of receipt of a certified copy of this order. In case it is found that the petitioner is entitled for any relief, the same shall also be released to him within a period of next three months. Present writ petition stands disposed of.
