A civil suit along with an application for grant of temporary injunction under Order 39 Rules 1 & 2 CPC is pending before the learned Additional Civil Judge (Senior Division), Bilaspur. The petitioner-plaintiff prays that the trial Court be requested to decide the application for grant of temporary injunction.

From the perusal of various interim orders, it is apparent that the case has been adjourned repeatedly by granting short adjournments on the request of learned counsel for the parties. Learned counsel for the petitioner-plaintiff submits that he shall not seek any further adjournment and the trial Court may be requested to hear and decide the application for grant of temporary injunction. He further undertakes that if on the next date of hearing his counsel does not appeal, the Court shall be competent to decide the application .
