(Oral) This petition is filed in the nature of certiorari for quashing the order dated 11.01.2017 by which the Arbitral Tribunal has partly allowed the applications filed under Section 17 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the "Act"). The petitioners are basically aggrieved against the award of `1,95,64,175/- in favour of the claimantrespondents, who have allegedly filed an application for execution before the Principal Civil Court (District Judge).

Counsel for the petitioners has submitted that on one hand the final award is not being announced by the Arbitral Tribunal as the matter has been kept reserved and on the other hand, execution application is being pressed by the claimant-respondents. It is, thus, prayed that the proceedings pending before the Executing Court may be stayed. After arguing for some time, counsel for the petitioners has submitted that he may be allowed to withdraw the present petition in order to

CWP No.6300 of 2017 [ 2 ] ***** file an appropriate application before the Executing Court where the application for execution filed by the claimant-respondents is pending pursuant to the impugned order having been passed in their favour. Dismissed as withdrawn.
