CORAM:HON'BLE MR. JUSTICE AMIT RAWAL -.- AMIT RAWAL J. (ORAL) The prayer in the writ petition is for taking up an appropriate action against the private respondent No.3 under the provisions of Haryana Panchayati Raj Act, 1994, who has been elected as Sarpanch in the election held for the said post on 24.01.2016. It is conceded position on record that the petitioner also contested for the said post but did not get the majority of votes.

The grievance of the petitioner could have been addressed by availing the remedy as per the aforementioned Act. Having failed to do so, the petitioner cannot circumvent the statutory provisions and adopt the course as indicated above.

In view of the aforementioned, the direction as sought for cannot be issued in the writ jurisdiction. The writ petition is not the correct remedy and therefore, no interference is called for. The writ petition is dismissed.
