SURYA KANT, J.(ORAL) Land of the petitioners measuring 16 marla situated in the revenue estate of village Badshahpur, Tehsil and District Gurgaon was acquired by State of Haryana for HUDA in the year 2011.The petitioners and other expropriated owners laid challenge to the acquisition in a bunch of writ petitions. This Court vide judgment dated 18.07.2013 passed in lead case, i.e. CWP-18418-2011 (Jeet Singh vs State of Haryana and others) though did not interfere with the acquisition but upheld the right of the expropriated owners for allotment of alternative plots under the 'Oustees Policy'.

[2] The petitioners are said to have applied in furtherance to that judgment, for allotment of plots under the 'Oustees Policy' but their claim has not been decided so far, thus, compelling them to approach the Court again.

CWP-6357-2017 -2- [3] Having heard learned counsel for the parties and keeping in view the nature of relief sought in this writ petition, the same is disposed of with a direction to the Estate Officer, Gurugram as well as the Administrator, HUDA, Gurugram, to consider the above-stated claim of petitioners as contained in the representation dated 20.01.2014 (Annexure P4) and decide the same as per the Policy, which was applicable at the relevant time within a period of four months from the date of receipt of a certified copy of this order.
