(Oral) The petitioner is aggrieved of the impugned order dated 09.06.2016 passed by the Sub-Divisional Canal Officer which is appealable before the Superintending Canal Officer as per the provisions of Section 20 of the Haryana Canal and Drainage Act, 1974.

Confronted with the aforementioned situation, learned counsel for the petitioner seeks leave of the Court for withdrawal of the writ petition with liberty to avail the aforementioned remedy provided that the period spent in this Court may be condoned.

Keeping in view the aforementioned facts and circumstances of the case, much less provisions of law, the present writ petition is ordered to be dismissed as withdrawn with liberty as prayed for provided that in case, the aforementioned remedy is availed within a period of 15 days from the date of receipt of certified copy of this order, delay shall be condoned as per the provisions of Limitation Act.
