***** ARCHANA PURI, J. (Oral) The petitioner has invoked the jurisdiction of the Court under Article 227 of Constitution of India, thereby making prayer for issuance of direction to Principal Judge, Family Court, to hear and adjudicate the case bearing HMA/1708/2021, on urgent basis.

It is submitted by learned counsel appearing on behalf of the petitioner that the petitioner had filed the petition under Section 13 of Hindu Marriage Act, 1955, for seeking divorce from the husband, namely, Amandeep Rai s/o Sh. Harbans Lal. However, the respondent had not made appearance in the said divorce petition and was proceeded against ex parte. Despite having concluded the ex parte evidence, now the case had been adjourned further for 09.01.2024, for final arguments.

 CR-4748-2023 It is further submitted that the difficulty faced by the petitioner is that, she is resident of Italy and her child is three and half years old, whose education is to begin in Italy in the month of September, 2023, as per Annexure P-4.

Considering the submission, so made, more particularly, when the respondent had already been proceeded against ex parte, in the divorce petition and only arguments are to be heard by the court concerned, in view of the provisions of Section 21(c) of Hindu Marriage Act, 1955, for expeditious disposal of the case, the petitioner, as such, shall make appearance before the concerned Court on 25.08.2023 and the court concerned shall consider the submission made by the petitioner sympathetically and proceed further.
