(ORAL) The prayer in the writ petition is for implementation of the Rates Circular No.40/2004 issued by respondent No.1 and restraining the respondents from levying and recovering demurrage and wharfage charges and also sought quashing of the order dated 09.03.2009 (Annexure P-3). If the petitioner is aggrieved against the levying and recovering of demurrage and wharfage charges, he can always claim the damages in the competent court under Section 9 of the Code of Civil Procedure but not in the mode and manner as sought for.
