In the present petition, the claim of the petitioner is that he is entitled for reinstatement in service and for the release of the pending wages/salary.

As per reply filed by respondent-State, it has been mentioned that after filing the present petition, the petitioner was re-engaged for a period of six months i.e. from November, 2017 to April, 2018 on DC rate. Thereafter, all the wages/salary due to the petitioner till date has already been cleared and no dues are pending with the department concerned. 3.

There is no replication filed to controvert the said submission in the reply.

Learned counsel for the petitioner submits that though, the statement has been made in the reply with regard to the payment of all the dues to the petitioner but no such instructions have been received from the petitioner, hence, without doubting the averments made in the reply, the present petition may kindly be disposed of having been not pressed but with RIYA 2023.11.09 18:53 I attest to the accuracy and integrity of this document

CWP No. 3767 -2018 -22023:PHHC: 141164 liberty to the petitioner to file appropriate representation with the respondents in case, any of his dues are still liable to be paid and the respondents be directed to decide the said representation in a time bound manner. 5.

Learned State counsel submits that in case, any representation is filed by the petitioner claiming any benefit, the same will be considered and decided in accordance with law within a period of eight weeks from the date of receipt of such representation by passing appropriate speaking order and in case, after the decision, the petitioner is found entitled for any benefit, the same will be extended to her within a further period of four weeks.. 6.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed, at this stage, with liberty to file an appropriate representation with respondents.
