SANDEEP MOUDGIL, J (ORAL) Petitioner has preferred instant petition under Section 482 of BNSS read with Section 528 of BNSS for grant of pre-arrest bail to the petitioner in view of judgment passed by the Division Bench of this Hon'ble Court in case titled Bharat Inder Singh Chahal Vs. State of Punjab reported in 2007(3) RCR (Criminal) page 977 as he has a genuine apprehension of false implication at the instance of respondent No.5.

Mr. J.S. Rattu, DAG, Punjab accepts notice on behalf of respondentState of Punjab and assures that if the presence of the petitioner is required for any purposes of investigation, a notice under Section 41(1) would be served upon him at the first instance before summoning to the police station. In the wake of assurance given by learned State counsel, learned counsel representing the petitioner does not press the instant petition. Prayer is accepted.
