CRM-M-34913-2026 (O&M) -2accused, namely Pritam alias Dhola and Rahul. It is submitted that the said co-accused have already been arrested and have since been granted the concession of regular bail.

On advance notice, Ms. Malvika Singh, learned DAG, Haryana, accepts notice on behalf of the respondent-State. 6.

Having heard learned counsel for the parties, this Court finds that role attributed to the petitioners is not in dispute. Moreover, offences alleged are triable by the Court of learned Magistrate. Both the petitioners are stated to be about 20 years of age, and are not alleged to be habitual offenders.

On being asked by the Court, learned State counsel, on instructions from SI Ramphal, submits that petitioner No.1 namely Prince is involved in two other criminal cases. However, he has not been convicted in any other case, till date.

In the facts and circumstances of the case, this Court does not find it necessary to keep the present petition pending any further and, accordingly, deems it appropriate to dispose of the same, with the direction to the petitioners to join the investigation within two weeks from today or as and when called by the investigating officer, and in the eventuality of the arrest, petitioners would be released on anticipatory bail, subject to their furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioners shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).

Besides, it is directed that petitioners would hand over their passports to the Investigating Agency or to Court concerned, if they possess. Otherwise, would submit an affidavit, disclosing the fact that they do not possess any passport.

It is also directed that before leaving country any time during trial, petitioners would seek prior permission of the Court. 10.

However, it is clarified that if the petitioners fails to join and cooperate with the investigation, in terms of the directions mentioned in the present order, it shall be open for the Investigating Officer to proceed immediately to arrest the petitioners, in accordance with law. 11.

With the directions recorded here above, present petition stands disposed of.
