The petitioner - Labh Chand, who is working as Pump Operator in the office of Sub Divisional Engineer, Water Supply & Sanitation, Sub Division No.1, Patiala, assails order dated 13.11.2018 (Annexure P-5) vide which the representation filed by the petitioner seeking regularization on the basis of order dated 8.2.2017 passed in CWP-21251 of 2014 titled Nasib Singh and others Versus State of Punjab and others, has been ordered to be kept pending till the decision of LPA No.714 of 2018 titled State of Punjab and others Versus Nasib Singh and others, which had been filed so as to challenge order dated 18.2.2017 passed in Nasib Singh's case (supra). 2.

Learned counsel for the petitioner submits that although the case of petitioner for regularization has been kept on hold till date but in case of some other identically situated persons namely Nirmal Singh, Kesar Singh, Shamlal and Paramjit, whose cases for regularization had also previously been kept PANKAJ KAKKAR 2023.08.21 18:05 I attest to the accuracy and authenticity of this document

CWP-17936-2023 (O&M) ( 2 ) 2023:PHHC:108451 pending on account of pendency of LPA No.714 of 2018, have been regularized w.e.f. 24.5.2011, as would be evident from order dated 16.2.2023 (Annexure P-8), though the regularization has been made subject to final decision in LPA No.714 of 2014. It has been submitted that although the petitioner submitted legal notice dated 3.2.2023 (Annexure P-6) as well as representation dated 10.5.2023 (Annexure P-7), but till date the same remain undecided.

Pursuant to service of advance notice Mr. Inderpreet Singh Kang, AAG, Punjab has put in appearance on behalf of the respondents and has fairly submitted that the respondents shall consider/decide legal notice dated 3.2.2023 (Annexure P-6) as well as representation dated 10.5.2023 (Annexure P-7) by passing a speaking order while duly taking into account the cases of other identically situated employees.

It is expected that the respondents will take a final decision in the matter expeditiously preferably within a period of 4 months from today. 6.
