AMIT RAWAL J. (Oral) Prayer in present writ petition is for issuance of a writ in the nature of mandamus directing the respondents to consider the claim of petitioner for promotion as Superintending Engineer in the cadre of Municipal Corporation Engineers on the basis of his seniority and eligibility.

On asking of Court, Mr. R.K.Doon, Assistant Advocate General, Haryana, who is present in Court, accepts notice on behalf of respondents/State Mr.G.S.Bal, learned Senior Counsel assisted by Mr. A.D.S.Bal, Advocate appearing on behalf of petitioner submits that petitioner, at this stage, would be satisfied if a direction is issued to respondent No.1 to consider and decide representations dated 19.03.2019 and 29.03.2019 SAVITA KADIAN 2019.09.09 09:56 I attest to the accuracy and integrity of this document High Court Chandigarh

In view of statement made by learned senior counsel for the petitioner and without going into merit of case or commenting thereon, present writ petition is disposed of with a direction to respondent No.1 to decide the representations dated 19.03.2019 and 29.03.2019 (Annexures P-4 and P-5) respectively, by passing a well reasoned and speaking order within a period of two months from the date of receipt of certified copy of this order.

In case, representation is not decided within aforementioned specified time, there shall be costs of Rs.25,000/- to be paid by the concerned officer to the petitioner.

However, it is made clear that in case, any promotion is made during the pendency of representations, aforementioned, the same shall be subject to the outcome of representations of the petitioner.
