NIDHI GUPTA, J. (ORAL) Prayer in this petition filed under Section 482 Cr.P.C. is for quashing the impugned order dated 18.05.2023 (Annexure P-4) passed by the learned Chief Judicial Magistrate, Moga, declaring the petitioner as proclaimed offender in case FIR No. 0111 dated 28.05.2022 registered under Sections 376, 323 and 506 IPC at Police Station City, Moga, District Moga.

On instructions, learned counsel for the State has informed that after passing of the impugned order declaring the petitioner as proclaimed offender, FIR under Section 174-A IPC has been registered against the petitioner.

Learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, with liberty to file a fresh one with better particulars including the prayer for quashing of FIR under Section 174-A registered against the petitioner. Permitted to do so.
