* * * * This appeal came up for hearing before Hon'ble Mr. Justice K. Kannan, as his lordship then was and the following order was passed on 24.12.2015 in the presence of the learned counsel for the parties:- There shall be an additional compensation of `35,000/- in favour of the claimant in full quit of all claim against the insurance company. The counsel shall file an affidavit authorizing the counsel to enter into the compromise for the amount satisfied above. The insurance company shall make the payment in cheque drawn in the name of the party or deposited to the account, the details of which shall be supplied by the counsel to the insurer within a period of three weeks from the date of receipt of copy of this order. If the amount is not paid within the time stipulated, the above amount shall also carry interest @ 7%.

Learned counsel appearing for the Insurance Company submits that a cheque No.697001 for an amount of `35,000/- was drawn in favour of the appellant and was handed over to the learned counsel representing the appellant against signatures on February 24, 2016. Counsel further points out that the affidavit of the appellant dated 10.02.2016 is also available on the record, whereby the appellant authorized his counsel to receive the cheque on his behalf.

The original receipt of the cheque having been received by the learned counsel for the appellant has been today placed on record by the learned counsel for the Insurance Company.

In that view of the matter, this appeal is disposed of having been settled. File be consigned.
