CWP-3865 of 2018 the merits and demerits of the candidates found respondent No.4Mohinder Singh as a suitable candidate and accordingly vide order dated 23.05.2012 appointed respondent No.4 -Mohinder Singh as the Lamberdar of Village Rajpura.

Feeling aggrieved against the Collector's order, the petitioner filed an appeal before the learned Divisional Commissioner. Patiala, however the same was dismissed vide order dated 16.05.2013 (Annexure P-5). A further revision filed by the petitioner before the learned Financial Commissioner, Punjab, Chandigarh was also dismissed vide order dated 11.12.2017( Annexure P-6). 4.

In the aforementioned circumstances, the present writ petition has been filed by the petitioner.

During the course of hearing of this petition, learned counsel appearing on behalf of respondent No.4 has submitted that the petitioner is not readily available in the Village as he is working as an Office Assistant in Chandigarh Group of Colleges, Landran. He submits that on account of his nature of jobs/duties, the petitioner cannot take out time to discharge the duties of a Lamberdar. The aforesaid stand taken by learned counsel for respondent No.4 has not been disputed by learned counsel for the petitioner and he has rather conceded that petitioner indeed is working as an Office Assistant with the Chandigarh Group of Colleges, Landran.

It is well settled that in the matter of appointment of a Lamberdar, the availability of a candidate in the Village to discharge the duties of Lamberdar is one of the paramount considerations. Since

CWP-3865 of 2018 the petitioner would not be readily available in the Village to discharge the duties of the post of Lamberdar and considering the fact that all the authorities have concurrently held in favour of respondent No.4 and found him suitable for the post of Lamberdar; accordingly, I find no compelling reason to interfere in the present matter. 7.

Resultantly, the present writ petition fails and is accordingly dismissed.
