Tribhuvan Dahiya, J (Oral) The petition has been filed, inter alia, seeking a writ of mandamus, directing the respondents to consider the petitioner eligible and qualified for the post of Trained Graduate Teacher (Music) against advertisement 2/2023, dated 21.02.2023.

Learned State counsel, on instructions received from Secretary of the Commission, submits that on reviewing the case, the petitioner has been declared eligible having the requisite qualification for the post in question, and has been recommended for appointment also. A communication to that effect, dated 24.09.2024, has been sent by the Secretary to the second respondent which is as under:

.... The Commission has decided to recommend the name of the petitioner in BCA category. The Petitioner namely Satish Chander bearing Roll No. 2233000070, has scored total 52.25 marks, whereas, the last selected candidate of BCA category scored 44.65 marks (TGT Music ROH). The Petitioner has scored more marks than the last selected candidate. As per law of merit and overall performance under the criteria, he falls in selection zone and selected at merit 6-A in BCA AVIN KUMAR 2024.09.26 17:44 I attest to the accuracy and integrity of this judgment/order.

CWP No.19459 of 2024 [2] category and recommended for the post of TGT Music (ROH), against the Advt. No. 02/2023, Cat. No.3.

2. The selected candidate has not been medically examined and no special enquiry in his antecedent has been made. The document pertaining to his Essential Qualification, Age, Caste/Category, Universities, and Experience as claimed by him in the application form may please be got checked/verified from the issuing authorities, before he is allowed to join her duty. A copy of the appointment letter issued to the candidate may also be endorsed to the Commission.

In view thereof, learned counsel for the petitioner contends that the concerned respondent may be directed to issue the letter of appointment.

Accordingly, the petition stands disposed of with a direction to the second respondent to act upon the Commission's recommendation, dated 24.09.2024, and issue letter of appointment to the petitioner as per merit subject to his fulfilling the requisite conditions, within six weeks of receiving a certified copy of the order.
