Tribhuvan Dahiya, J. (Oral) This petition has been filed seeking a writ of mandamus directing the respondent Department to consider and promote the petitioner on the post of PGT-Social Studies w.e.f. 08.01.2021, i.e., the date when his juniors were so promoted.

It is contended that the petitioner fulfilled all the requisite qualifications, including the experience, on the date his juniors were so considered and promoted. He has been denied consideration for no valid reasons. Even the representation submitted in that regard, dated 30.03.2023 (Annexure P-4), remains undecided.

In view thereof, without commenting anything on the merits of the case, the petition stands disposed of directing respondent no.3 to decide the pending representation of the petitioner, Annexure P-4, by passing a speaking order in accordance with law, within a period of six weeks from the date of receiving certified copy of this order. In case the petitioner is found entitled to be promoted, necessary order to that effect will be passed within four weeks thereafter.
