CORAM:HON'BLE MR. JUSTICE AMIT RAWAL -.- AMIT RAWAL J. (ORAL) The relief sought in the present writ petition has become obsolete. None of the representations reveals outcome of the appeal, in essence, the writ petition is bereft of the status of appeal filed against the dismissal order on the basis of enquiry conducted against the petitioner i.e. too way back in the year 1989. No explanation has come forth in this regard. Even the petitioner cannot remain idle for a period of 26 years and watch to the outcome of the appeal and just woke up, owing to the filing of the suit for recovery. Though the suit was dismissed and appeal filed against the same also dismissed for non-prosecution and RFA has been filed. Even the fact that the application for seeking information under RTI had been relegated to the District Judge is not a ground for remaining idle.
In my view, the petitioner is guilty of doctrine akin to delay and latches. He should have fetched out the information under the Right to Information Act regarding the outcome of the statutory appeal. I do not intend to interfere in respect of the prayer sought in the writ jurisdiction. The writ petition is dismissed.
