RA-CW-287-2025 in CWP No. 11102 of 2025 This review application has been filed by the applicant-petitioner with a prayer for grant of liberty to raise the issue of challenge to the condition by which a bond of Rs. 20 lacs was required to be filled by each candidate in case the student failed to complete his residency tenure and/or if the student opt out of PG course after cutoff date.

No doubt, the applicant-petitioner has raised this ground in para-9 and in prayer Clause (iii) of Civil Writ Petition No. 11102 of 2025 but a bare perusal of the order under review reveals that the said ground was not pressed. There is not even whisper of any such contention made by learned counsel for the applicant-petitioner in the writ petition and therefore, principle of constructive res judicata comes in the way of the applicant-petitioner for raising this prayer. Reliance in this regard is placed on the judgments rendered by the Apex Court in Devi Lal Modi vs. Sales Tax Officer AIR 1965 SC 1150 RAVINDER KUMAR 2025.08.04 18:42 I attest to the accuracy and integrity of this document
