(Oral) The petitioner - Jaswinder Singh has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No. 112 dated 06.08.2022, under Sections 406 and 498-A of IPC, registered at Police Station Dugri, Ludhiana, Punjab.

As per the facts of the case, the complainant - Sandeep Kaur filed a written complaint to the police levelling allegations against her husband Jaswinder Singh and other members of her in-laws family for treating her with cruelty, for bringing less dowry and for raising demand of Rs. 5,00,000/- and more dowry articles. It was further alleged that all her dowry articles have been embezzled by the members of her in-laws family. She has given the detail of dowry articles given to her at the time of marriage. It is alleged that despite the intervention of Panchayat, the matter could not be reconciled. Therefore, the present complaint was filed, on the basis of which present FIR has been registered. CRM-M-42679-2022 -2Learned counsel for the petitioner pointed out that the matter has been compromised between the parties with the intervention of Mediation and Conciliation Center. The settlement/agreement is also on the record. Both the parties have decided to take divorce under Section 13-B of Hindu Marriage Act as per the agreed terms and conditions. The present petitioner is further ready to join the investigation. Therefore, his anticipatory bail application may be allowed. Learned counsel representing the State as well as learned counsel representing the complainant confirmed the aforesaid facts. I have considered the factual position. The matter has been compromised between the parties. The present petitioner has already joined the investigation. He is not required for any other purpose. Considering these facts, the interim bail already granted in favour of the petitioner Jaswinder Singh vide order dated 16.09.2022 stands confirmed, subject to the conditions as enshrined under Section 438(2) Cr.P.C. The petition is, accordingly, accepted.
