Grievance raised by the petitioners is that illegal encroachment has been carried out over the public passage by respondents no.9 to 11. It is submitted that Gram Panchayat-respondent no.8 has failed to perform its statutory duties despite petitioners approaching the Gram Panchayat. It is further submitted that petitioners approached the authorities in this respect but no action is being taken.

Perusal of the two representations attached with this writ petition reveals that one of the representation is addressed to the Chief Minister, State of Punjab, though, it is submitted by learned counsel for the petitioners that copies thereof have been submitted to authorities and other representation is to the Executive Engineer, Punjab Mandi Board, Fazilka, who in any case, is not even a party to this writ petition.
