Learned State counsel submits that State has also preferred a writ petition against the same order as impugned in the instant petition. However, same was dismissed with liberty to avail the remedy of arbitration. This order is annexure R1 to the reply filed by the State. In view of above, no cause of action survives in this petition. Same is hereby disposed of with liberty to the petitioner to avail the remedy of arbitration in the first instance.
