This matter is being taken up for hearing through video conferencing due to the outbreak of pandemic, COVID-19. Petitioner claims that service rendered by him on daily wage and work charge basis before his regularization should have been counted for the purposes of pensionary benefits etc.

Learned counsel for the petitioner submits that pursuant to serving legal notice dated 18.03.2020(Annexure P-2) the Executive Engineer, HVPNL, Karnal vide communication dated 28.08.2020 (Annexure P-5) stated that no representation to this effect had ever been received by their office and in case, such a representation is submitted, it would be considered as per entitlement of the petitioner. It is further submitted that SUNIL 2020.12.18 15:47 I attest to the accuracy and authenticity of this document

CWP-21902-2020 thereafter, another legal notice dated 16.09.2020 (Annexure P-6) was submitted, but still no action is being taken by the respondents. At this stage, learned counsel for the petitioner restricts his prayer for a decision of his claim,in a time bound manner. Notice of motion.

Mr. Ashish Yadav, Addl.A.G., Haryana, accepts notice on behalf of all the respondents. Advance copy of the writ petition stands served.

Heard.

Keeping in view the facts and circumstances of this case, but without any expression of opinion on the merits of the matter, it is considered expedient, at this stage, to direct thecompetent authority to decide the claim as raised by the petitioner.In case, a comprehensive representation is submitted by the petitioner within two weeks from today, the competent authority shall consider the matter and take a decision thereon by passing a speaking order, within a period of three months from receipt of certified copy of this order.

Petition is disposed of accordingly.
