In this petition filed under Articles 226/227 of the Constitution of India, the petitioner has prayed for issuance of a writ in the nature of mandamus direction respondent No.2 to decide the representation dated 27.11.2017 (Annexure P-2) in a time bound manner. 2.

Earlier, the petitioner filed CWP-23005-2010 and this Court vide order dated 7.11.2017 (Annexure P-1) disposed of the said writ petition with a direction that the petitioner may represent to the respondents to reconsider the question of deduction 10% of the price of the plot and interest on the refund amount returned by the petitioner with a further direction to the respondents to consider the request and take a decision thereon in view of the fact that they have had the use of the amount at least from 16.11.2010. Learned counsel for the petitioner submitted that for the relief claimed in the writ petition, the petitioner has sent the representation dated 27.11.2017 (Annexure P-2) to respondent No.2, but no action has so far been taken thereon.

After hearing learned counsel for the petitioner, perusing the present petition and without expressing any opinion on the merits of the case, we dispose of the present petition by directing respondent No.2 to take a decision on the representation dated 27.11.2017 (Annexure P-2), in accordance with law by passing a speaking order and after affording an opportunity of hearing to the petitioner within a period of two months from the date of receipt of the certified copy of the order.
