The instant petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 / Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking quashing of the impugned order dated 15.06.2026, whereby the petitioner has been declared a proclaimed person in FIR No.33 dated 13.04.2025 under Sections 109, 115(2), 351(2), 191(3) and 190 of the Bharatiya Nyaya Sanhita, 2023 (corresponding to Sections 307, 323, 506, 148 and 149 of the Indian Penal Code, 1860), as well as under Sections 25 and 27 of the Arms Act, 1959, with a subsequent addition of Section 117(2) of the Bharatiya Nyaya Sanhita, 2023 (corresponding to Section 325 of the Indian Penal Code), registered at Police Station Bareta, District Mansa. 2.
It is contended that the petitioner was granted anticipatory bail in the present case by this Court vide order dated 22.05.2025. It is further submitted that the challan was presented in his absence. Subsequently, FIR No.91/2025 was registered against the petitioner and other co-accused, wherein his application for anticipatory bail was dismissed by the learned Sessions Court, Mansa. Thereafter, the petitioner approached this Court by filing CRM-M No.33997 of 2026, wherein vide order dated 17.06.2026, interim protection was granted in his favour and in the meantime, as petitioner could not appear before the SAURAV PATHANIA 2026.07.03 12:43 I attest to the accuracy and integrity of this document
CRM-M-35021-2026 learned trial Court in the other FIR i.e. FIR No.33/2025 registered at Police Station Bareta, learned Judicial Magistrate, First Class, has declared petitioner a proclaimed person vide impugned order. Petitioner failed to appear before the Court apprehending his arrest in the subsequent FIR registered against the petitioner for which he was before this Court and he was not intentionally evading appearance but was compelled by the circumstances and he is ready to appear before the trial Court.

Mr. Jasjit Singh Rattu, learned Deputy Advocate General, Punjab, accepts notice on behalf of the State of Punjab. 5.
I have heard learned counsel for the parties and perused the record.

Considering the facts and circumstances of the case, the present petition is allowed. The impugned order dated 15.06.2026 is set aside. The petitioner is directed to appear before the learned trial Court within a period of seven days from today. Upon his appearance, he shall be released on bail to the satisfaction of the learned trial Court, in terms of the order dated 22.05.2025 passed by this Court in CRM-M No.27132 of 2025.
