TRIBHUVAN DAHIYA, J. (ORAL) With the consent of learned counsel for the parties, the main case is taken on Board today itself.

The petition has been filed inter alia seeking a writ of mandamus directing respondent no.3 to grant the first, second, third and fourth ACP scales along with seniority due to the petitioners, who are working in the respondent Department as Lecturers of Management/ Computer Engineering.

Learned senior counsel contended that the benefit of ACP scales was declined to the petitioners on the ground that the regularisation policy under which their services were regularised vide order dated 29.08.2014, was under challenge before the Supreme Court in SLPs filed against CWP No.17206 of 2014 titled Yogesh Tyagi and another v. State of Haryana and others, and connected cases. These cases have now been decided vide MANINDER 2026.05.30 17:02 I attest to the accuracy and authenticity of this order/judgment judgment dated 16.04.2026, rendered in Madan Singh and others v. State of

CM-8980-CWP-2026 in/and 2 CWP-6795-2017 (O&M) Haryana and others, 2026 INSC 379. In terms therewith, the petitioners are entitled to regularisation under the Government notification dated 07.03.1996. At this stage, they will be satisfied in case they are permitted to make an appropriate representation before the respondents raising the said grievance, which may be ordered to be decided within a specified period. All relevant particulars of the petitioners' services which entitle them to the claimed benefit will be mentioned therein.

Learned State counsel submits that in case any such representation is filed by the petitioners within four weeks from today, the same will be decided by respondent no.2 - Director, Technical Education, by passing a speaking order thereupon in accordance with law in the light of Madan Singh case ibid., within six months of receiving the representation. And all consequential benefits including the ACP scales, if found admissible, will be released to them within four weeks thereafter. 5.

In view of the statement made, learned counsel for the petitioners has no objection to the petition being disposed of in terms thereof.

Ordered accordingly.

In case the order is not passed and the benefits found admissible are not released within the stipulated periods, the officer concerned shall pay costs of `50,000 to the petitioners.

Pending miscellaneous application(s), if any, also stand(s) disposed of.
