As per case of the petitioner - Rahul Singla, he was appointed as Fireman on contract basis for a period of one year or till the regularly selected candidates became available, vide letter dated 25.9.2019. A criminal case bearing FIR No. 35 of 2020 was registered against him with regard to the incident of fire breaking out at Municipal Office, Nuh on the midnight of 25.1.2020. The petitioner applied for and was granted pre-arrest bail. When he went to his office to join his duties, respondent no.4 - Fire Station Office, Nuh through Fire Station Officer, refused to allow him to do so. Thereafter, the petitioner came to know that respondent No.4 had requested respondent No.3 to appoint a new employee on contractual basis in place of petitioner, which was further forwarded to BANITA CHUGH 2021.12.06 14:21 I agree to specified portions of this document

CWP No. 21958 of 2020 -2respondent No.2. Since the petitioner was not allowed to join the duties, he had submitted a representation dated 16.11.2020, copy Annexure P-8, to respondent no.2 - Local Urban Bodies and Fire Service, Haryana, Panchkula, through its Director, but that did not evoke any response, as such petitioner has filed the present writ petition.

I have heard, learned counsel for the parties, besides going through the record.

Keeping in view the facts and circumstances of the case and in order to avoid unnecessary litigation and to enable the respondents to consider the claim of the petitioner and then to take appropriate action, if need be, the present writ petition is disposed of directing respondent No.2 to consider the representation dated 16.11.2020 (Annexure P-8) submitted by the petitioner, as per law, rules, regulations and instructions on the subject and if some action in the matter is warranted, then the needful be done in accordance with law, within a period of two months from the date of receipt of copy of this order. A speaking order in that regard be passed, copy of which be sent to the petitioner as per registered AD Post. It is observed that in case the petitioner still feels dissatisfied after disposal of his representation, then he may approach the Court again in accordance with law for redressal of his grievances.
