The short issue involved in this case is whether property of which possession is sought to be taken is the same property which was mortgaged with the bank. It being a disputed question of fact, no findings can be returned by this court in this writ jurisdiction. Admittedly, however, possession of the property has been handed-over back to the petitioner. Learned State counsel, on instructions from Mr. Sanjeev Kumar Gaur, Tehsildar, Patiala, who is present, in court submits that another verification shall be carried out by the revenue authorities. Same shall also be examined by the Deputy Commissioner, Patiala. Further action shall be taken only thereafter, in any case not later than three months.
