By this petition, the petitioner has prayed that his claim for participating in the Preliminary Examination of HCS (Judicial Branch) Examination against Advertisement No.1/2021 dated 13.01.2021 (Annexure P-1) followed by a corrigendum dated 13.08.2021 (Annexure P-2), be considered by respondent No.2.

As per the petitioner, against the corrigendum issued by respondent no.2, he has submitted his application form being eligible and qualified for the post advertised but he was not able to submit the necessary declaration form, due to some technical defect. 3.

Learned counsel has argued that the fact that the declaration form of the petitioner was not submitted by the petitioner, due to some technical defect and has urged that this petition may be treated as a mercy petition.

We cannot accede to this request as once the petitioner could not submit the declaration form, it has to be held that the application was not complete on the last date and therefore, the petitioner cannot now claim that he will submit the same and should be allowed to take part in the examination.
