M.M.S. BEDI, J. (ORAL) The husband, aggrieved by the dismissal of his petition for divorce under Section 13 (1) (ia) of the Hindu Marriage Act vide judgment and decree dated 30.10.2013, has preferred this appeal which was admitted on 23.2.2016.

During pendency of the appeal, the parties appear to have entered into some amicable settlement to get the marriage dissolved by filing a petition under Section 13-B of the Hindu Marriage Act, on the terms settled between them.

CM-10999-CII-2018 and FAO-617-2014 (O&M) Counsel for the respondent has also confirmed the factum of parties having arrived at a settlement which contains a term that this appeal would be withdrawn.

In view of above circumstances, the misc. application for withdrawal of the appeal is allowed. The main appeal is taken on board. The main appeal is dismissed as withdrawn. The parties shall remain bound by the terms of settlement. Any of the parties would be entitled to seek revival of the appeal in case of breach of any of the terms of settlement within a period of one year.
