  Through this revision petition, filed under Article 227 of the Constitution of India, the petitioners pray for setting aside the order dated 07.10.2021, passed by the Additional Civil Judge (Sr. Division), Panchkula, while refusing to club the proceedings of two independent suits. While dismissing the application, the Court has observed that though the subject matter of the suits is same, however, the relief sought by the parties in both the suits is distinct. The Court has also noticed that the certain parties in both the suits are also different. The learned counsel representing the petitioners has stated that both the suits are pending before the same Presiding Judge and both are at the initial stage.

If that be so, let the Presiding Judge, explore the possibility of deciding both the suits simultaneously on a particular date, so as to avoid NARESH KUMAR 2021.11.12 13:20 I attest to the accuracy and integrity of this document

 

 any conflict in the decision. The Presiding Judge shall also make an attempt to take up both the suits on the same date(s) of hearing. Keeping in view the aforesaid facts, the civil revision is disposed of.
