CWP No.6924 of 2017 The allegation made in the writ petition is that the petitioner had been prevented to deposit the money, which would be a disputed question of fact, as he has to prove in whose presence, he attempted to deposit the earnest money for the purpose of entitling/making him eligible for participating in the bid with regard to auction of the flourish shop in Red Bishop, Sector 1, Panchkula.

This fact cannot be adjudicated in the writ petition and therefore, the petitioner can avail the remedy of civil suit, if he desires to do so. The writ petition stands disposed of with the aforementioned observations.
