*** Amol Rattan Singh, J. (Oral) By this petition, filed under the provisions of Section 439 of the Cr.P.C., the petitioner seeks the concession of 'regular bail'. The petitioner having been in custody for more than 08 months with only one prosecution witness out of 13 having been examined so far, and with no other criminal case shown to be registered against him as per the State counsel, (who states so on instructions from SI Major Singh), and counsel for the petitioner having submitted that as a matter of fact the petitioner cannot be stated to be in conscious possession of any contraband recovered from the truck owned and driven by his brother, without making any comment on the actual merits of the case, looking at the period of custody and the stage of the trial, seen with the aforesaid contention, this SATYAWAN 2019.12.04 14:06 I attest to the accuracy and integrity of this document
