AMIT RAWAL J. (Oral) The petitioner is aggrieved of the impugned order dated 07.12.2011, whereby, respondent No.5- Gurpreet Singh, has been appointed as Nambardar.

Mr. Jatinder Pal Singh, learned counsel for the petitioner submits that the petitioner is 45 years old and had worked as Sarbrah Lamberdar of village for a period of 5 years. He is educated upto 5th standard and has more experience, whereas, respondent No.5, no doubt, is younger in age but lacks experience. All these factors have not been taken into consideration by the authorities below.

I have heard learned counsel for the petitioner, appraised the paper book and of the view that respondent No.5- Gurpreet Singh is 25 years old and owns 22 acres of land. In fact, he is more educated and having more land than petitioner. In my view, the District Collector, is an independent authority for appointment of the Nambardar. The order of the

CWP No.6977 of 2017 {2} Collector does not suffer from any illegality and perversity, much less no ground is made out for interference.
