The prayer in the present petition under Articles 226/227 of the Constitution of India is for issuing a writ in the nature of mandamus directing the respondents to grant the benefit of the Assured Career Progression Scheme on completion of 4, 9 and 14 years of service in a cadre to the petitioner in view of the Notification dated 03.11.2006 (Annexure P-1).

Learned counsel for the petitioner would contend that in this regard a Legal Notice dated 24.08.2021 (Annexure P-5) has already been sent to respondent No.2, however, no decision has been taken qua the same. It is further contended that at this stage the petitioner would be satisfied if a direction is given to respondent No.2 to decide the said representation dated 24.08.2021 (Annexure P-5) in a time-bound manner. Heard.

CWP No.23053 of 2021 -2In view of the limited prayer made by learned counsel for the petitioner and keeping in view the fact that the matter is not being decided on merits, the service of notices upon the respondents is dispensed with at this stage.

Without commenting on the merits of the case, the present writ petition is disposed off with a direction to respondent No.2 to take a decision on the representation dated 24.08.2021 (Annexure P-5) in accordance with law expeditiously and, in any case, within a period of three months from the receipt of a certified copy of this order. Disposed off accordingly.
