(Oral) Learned counsel for the petitioners submits that in view of order dated September 12, 2017, a proposal was submitted by the petitioners for one time settlement as well as sending the matter to Assets Restructuring Company (ARC). However, proposal has been rejected by the Bank. Admittedly, proceedings under the SARFAESI Act have already been initiated.

Under the circumstances, no cause of action survives in this petition.

At this stage, learned counsel for the petitioners submits that she may be allowed to withdraw the petition with liberty to agitate before the appropriate Forum.
