HARINDER SINGH SIDHU, J Petitioner has filed present petition, praying for modification of order dated 10.08.2021 passed by learned SDJM, Dhuri in case FIR No.76 dated 18.06.2021 under Sections 61 and 78 of Punjab Excise Act registered at P.S City Dhuri whereby his application for release of a Car No.PB-13BD-2149 on superdari has been allowed subject to his furnishing cash surety/bank guarantee in the sum of Rs.1.5 lacs. Learned counsel for the petitioner submits that there is no other source of income except the vehicle in question and that the petitioner is not in position to comply with the condition of furnishing bank guarantee/cash surety. He is ready to furnish surety bonds of the same amount i.e Rs.1.5 lacs.
On the other hand, learned State counsel has supported the impugned order.
Having heard learned counsel for the parties and taking note of the facts, present petition is allowed. Order dated 10.08.2021 is modified to the extent that instead of furnishing bank guarantee/cash surety, the petitioner shall now file surety bonds of Rs.1.5 lacs for release of the vehicle on superdari besides complying with other conditions imposed vide the impugned order.
